MINUTES

NOVEMBER 9, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, November 9, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Rich Gaver, and John Phillips, III.

Also in attendance were Senator Andrew Serafini and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the minutes. Unanimously approved.

Senator Andrew Serafini

Senator Serafini introduced himself to the Mayor and Council. He spoke to the Council about the highway user funds. The Governor is planning on administering funds back to the municipalities.

A short discussion was held regarding legislative issues and goals for the Town.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, November 23, 2015, and will be hosted by the Town of Clear Spring. The meeting will be held at the Clear Spring American Legion located at 12335 Big Spring Road.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m. The menu for the evening will consist of steamed shrimp, prime rib, scalloped potatoes, green beans, garden salad, rolls and butter. The cost for this meal will be $25.00 per person.

MINUTES

OCTOBER 26, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, October 26, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Rich Gaver, John Phillips, III, and J.D. Taylor.

Also in attendance were Carter Doss, Tony Doss, Robert Kuczynski, Edward Kuczynski, Kery Swope, Kert Shipway, Barry Warrenfeltz, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Councilman John Phillips, III, seconded by Assistant Mayor Sharon Chirgott to approve the minutes with the following correction: change jamboree to camporee. Unanimously approved.

Audit Presentation – Albright, Crumbacker, Moul & Itell, LLC

Mr. Kert Shipway, Partner with Albright Crumbacker Moul & Itell, LLC presented the annual audit report. The Town has a “clean, unqualified opinion”.

Page 10 – Total primary government expenditures is $789,562.

Total charges for services are $305,670, which is down $50,000 from last year.

Property taxes increased $12,000, giving a general revenue total of $309,301. The change in net position for the end of the year is $99,908, which is an increase from last year.

Pages 11-12 Shows the Balance Sheet for the Governmental Fund.

Page 26 – Debt owed by the Town, and shows amount to be paid back over the length of the debt.

Deed of Easement and Agreement – 205 North High Street

The Renner Estate owns the property at 205 North High Street, and is being sold to Brelo, LLC (Mark Dickinson). An Easement is needed for the limited purpose of allowing and to continue to allow encroachment upon an undedicated public right of way at 205 North High Street.

Motion was made Councilman J.D. Taylor, seconded by Councilman John Phillips, III to approve the Easement for 205 North High Street, and to adopt a Resolution approving the Easement for 205 North High Street. Unanimously approved.

Bills

Motion was made Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to pay the bills. Unanimously approved.

Misc

Mr. Barry Warrenfeltz asked the Mayor and Council to consider a discount on the water/sewer bills for senior citizens.

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips, III to adjourn to closed session. Unanimously approved.

SEPTEMBER 14, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, September 14, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Robert Rodgers, Jr., Rich Gaver, J.D. Taylor, and John Phillips, III.

Also in attendance were Nina Rice, Elizabeth Sullivan, Chad Rupert, Patrick Moore, Sinjin Shoop, Colin Osborne, Kenny Daniels, Matt Smith, Patrick O’Conner, Hunter Martin, Luke Harsh, Barry Warrenfeltz, Jullianna Albowicz, Joseph Montano, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the minutes. Unanimously approved.

Funkstown Legion Post 211 Baseball Team

Senator Barbara Mikulski and Representative John Delaney presented the Legion Baseball Team with a Special Congressional Recognition Certificate for winning the Maryland State Championship.

Mayor Paul Crampton presented the Baseball Team with a Proclamation for winning the Maryland State Championship.

Mayor Crampton stated that the baseball team brings a lot of life and enthusiasm to the park, and is a great asset to the Town.

Halloween Parade and Trick-or-Treat

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips to approve the Halloween Parade for Thursday, October 29th at 6:00 p.m. and Trick or Treat for Friday, October 30th from 6:00 to 8:00 p.m. Unanimously approved.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, September 28, 2015 hosted by the Town of Keedysville. The meeting will be held at the McClellan Gun Club located at 5241 Red Hill Road.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m. The menu for the evening will consist of grilled steak, baked potato, green beans, dessert and plenty of cold beverages. The cost for this meal will be $23.00.

Alsatia Mummer’s Parade Invitation

The Mayor and Council have been invited to participate in the 90th annual Alsatia Mummers’ Parade to be held on Saturday, October 31, 2015, starting at 6:00 p.m.

The Mayor and Council declined the invitation.

Funkstown Fire Company Fire Prevention Week

The Funkstown Volunteer Fire Company will be celebrating Fire Prevention Week on Saturday, October 10th from 9:00 a.m. to 4:00 p.m. with an open house/public safety day. The fire department would like to close South Westside Avenue at Baltimore Street and Maple Street. Street closure would start around 9:00 a.m. to allow time to set up equipment and re-open at approximately 4:00 p.m.

Motion was made by Councilman Rich Gaver, seconded by Councilman Robert Rodgers, Jr. to allow the fire company to close Westside Avenue on October 10th for Fire Prevention Week. Unanimously approved.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to pay the bills. Unanimously approved.

Misc

Councilman Rich Gaver stated that the Boy Scout Jamboree on October 2-4, 2015 was well received. If everything goes as planned, the event will take place again in a few years.

Councilman Rich Gaver stated that the Olde Tyme Christmas is scheduled for December 11, 2015 from 6:00 to 9:00 p.m.

Councilman Robert Rodgers, Jr. thanked Barry Warrenfeltz for enlightening the Town to recognize the Funkstown American Legion Baseball Team.

AUGUST 10, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, August 10, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Rich Gaver, and J.D. Taylor.

Also in attendance were Barry Warrenfeltz and Brenda Haynes, Clerk-Treasurer.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Robert Rodgers, Jr. to approve the minutes. Unanimously approved.

Misc

Mr. Barry Warrenfeltz stated that the Funkstown American Legion Post 211 Baseball Team won the State Championship. He is getting a price on a 6×10 banner to place at the Funkstown Park to honor the team.

Mr. Warrenfeltz suggested that the Town do something to honor the team.

The Mayor and Council will invite the team to participate in the Halloween Parade and will honor them with a Proclamation.

Councilman Rich Gaver stated that the re-enactment went very well. There were over 300 re-enactors in attendance. The car show did not have a great turnout, but Tony Babbie on High Street won. The kid’s event should be re-evaluated due to a poor turnout.

Mayor Crampton suggested discontinuing the kid’s event, and focus on other activities.

Councilman Robert Rodgers, Jr. stated that the fire company sold food for the re-enactment. Saturday sales were down compared to last year, but Sunday sales were up. The fire company had a profit of $1,200.00.

Councilman Rich Gaver stated that the Boy Scout event scheduled for October 2-4, 2015 will have two merit badges that will be a Geocaching and Fire Safety.

JULY 13, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, July 13, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Assistant Mayor Sharon Chirgott, Rich Gaver, Robert Rodgers, Jr., Luke Barnette, John Phillips III and J.D. Taylor.

Motion was made by Councilman Rich Gaver, seconded by Councilman Robert Rodgers, Jr. to approve the minutes. Unanimously approved.

Waste Collection Contract

The waste collection contract was put out to bid. The bid for services shall be for the period commencing July 1, 2015, and terminating automatically on June 30, 2016, provided, however, that the Mayor and Council shall have the option, within its absolute discretion, to renew the contract under the same terms and conditions; and further provided that on 2017, the Mayor and Council shall have the option to renew the contract until 2018 at and for the same terms and conditions.

Apple Valley Waste Services, Inc. bid $58,250 annually.

BFI submitted two separate bids – $52,740 for year 1 – If the renewal options for Year 2 and Year 3 are exercised, the pricing will include an annual CPI adjustment effective July 1, based on the Water/Sewer/Trash Index. Also if Year 2 and 3 has any direct cost impact as a result of the following items will be passed through to the Town: Landfill price adjustments, direct operational cost impacts due to change in law, and fuel price adjustments.

Alternate Bid is for one year in the amount of $52,740.00.

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips III to accept the Alternate Bid from BFI for $52,740 for one year. Councilman Robert Rodgers, Jr. voted against the motion. Motion carried.

Motion was made by Councilman Rich Gaver, seconded by Councilman Robert Rodgers, Jr. to approve the bills. Unanimously approved.

Misc

Councilman J.D. Taylor stated that his house is for sale. He will keep the Council informed when he will be moving.

Councilman John Phillips III stated that the plans are ready for the Re-enactment. He will be going to Ohio, but he has Carl in charge until he returns.

The Saturday field battle will start and 4:00 p.m. and the Sunday battle will start at 1:00 p.m.

The Confederate Flag will be allowed in Funkstown, as long as it is a period flag.

Councilman Rich Gaver stated the The Day In The Park plans are ready.

The Boy Scouts are in charge of the Car Show which will be held from 4:00 – 7:00 p.m. on Saturday. The last registration will be Saturday at 3:00 p.m. The entry fee is $5.00.

The trophy has been donated by Aladdin Awards.

Councilman Rich Gaver stated that October 2 – 4, 2015 the Boy Scouts will have a large jamboree at the Park.

JUNE 8, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, June 8, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Robert Rodgers, Jr., Luke Barnette, and J.D. Taylor.

Also in attendance were Barry Warrenfeltz and Brenda Haynes, Clerk-Treasurer.

Public Hearning

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a proposed 2% water rate increase, and adoption of the General Fund and Enterprise Fund Budget. The public hearing is scheduled pursuant to the provisions of the Annotated Code of Maryland and the Charter of the Town of Funkstown, to consider whether or not to revise the water rates, and adopt the budgets.

The Mayor and Council will make a determination at a regular meeting.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to approve the minutes. Unanimously approved.

Budget

The proposed increase for the Enterprise Fund Budget is a 2% water rate increase.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to approve the General Fund Budget, and approve the Enterprise Fund Budget with a 2% water rate increase. Unanimously approved.

Motion was made by Councilman Robert Rodgers, Jr., seconded by Councilman Rich Gaver to approve the bills. Unanimously approved.

Misc

Councilman Rich Gaver stated that the Day In The Park event will host a car show. The entry fee will be $5.00 per vehicle, and the general public will vote for the best car in the show.

Councilman Luke Barnette stated that the Facebook page as of April 20th had two hundred likes. The current total is 528 likes.

Budget – Work Copy

A copy of the General Fund and Enterprise Fund budget was distributed for review. A workshop meeting has been scheduled for May 26, 2015 at 7:00 p.m.

Sign Ordinance Revision Approval

A lengthy discussion was held regarding updating the Sign Ordinance.

The Mayor and Council directed the town clerk to check with the Town Attorney regarding penalties to the Sign Ordinance.

Misc

Councilman Rich Gaver stated that the Boy Scouts will be having a spaghetti dinner at St. Paul’s Lutheran Church from 5:00 – 8:00 p.m. on May 16, 2015. The cost will be $6.00 per person.

Councilman Luke Barnette would like to promote Funkstown on the like section of Facebook. Motion was made by J.D. Taylor, seconded by Councilman Rich Gaver to allow $100 to be spent to promote Funkstown on Facebook using Hotel Motel funding. Unanimously approved.

APRIL 13, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, April 15, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, J.D. Taylor, and Robert Rodgers, Jr.

Motion was made by Councilman Rich Gaver, seconded by Councilman Luke Barnette to approve the minutes with the following correction: Mayor Paul Crampton, Jr. and Councilman Robert Rodgers, Jr. was absent from the meeting March 9, 2015. Unanimously approved.

Town Clean Up Date

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Luke Barnette to hold the annual Town cleanup on Friday, May 7th from 8:00 a.m. to 3:00 p.m., and Saturday, May 8th from 8:00 a.m. to 12:00 noon. Unanimously approved. Apple Valley Waste will run the cleanup. A detailed list of items that will be accepted, and proof of identification will be provided to Councilman Rich Gaver to post on the website.

Tree Planting Ceremony – April 19, 2015

A tree planting program will be held at the Funkstown Community Park on Saturday, April 18th starting at 9:00 a.m. Ms. Becky Wilson, Department of Natural Resources has worked closely with the Town to acquire grant funding for this project. Volunteers will help with the tree planting.

Mayor Paul Crampton, Jr. will present a Proclamation for the program.

Tim Thompson – Military Banners

Mr. Thompson did not show up at the meeting.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to pay the bills. Unanimously approved.

Misc

Councilman J.D. Taylor stated that Herbert Smith is experiencing difficulty parking in front of his property. He has a handicapped sign for his vehicle.

Mayor Paul Crampton, Jr. directed the clerk-treasurer to have the Town place a handicapped sign in front of his residence.

Councilman Rich Gaver stated that the Boy Scout working on the Eagle Project at the park is waiting on good weather and funding.

Councilman Rich Gaver stated that the Boy Scouts will be painting 600 feet of fencing at the Funkstown Cemetery.

Councilman Robert Rodgers, Jr. stated that he would like to see a three year contract for waste collection, instead of a one year contract. Motion was made by Councilman Robert Rodgers, Jr., seconded by Councilman Rich Gaver to work on a three year contract for waste collection, including yard waste. Unanimously approved.

Councilman Luke Barnette questioned the franchise fee with Antietam Cable. The clerk-treasurer will pull the file, and email it to the Mayor and Council.

MARCH 9, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, March 9, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Rich Gaver, Robert Rodgers, Jr., John Phillips, III, and J.D. Taylor.

Also in attendance were Dennis Weaver, Tina Taylor, Barry Warrenfeltz, George Glenn Fuscsick Becky Wilson, Jamie Baker, and Brenda Haynes, Clerk-Treasurer.

Mr. Dennis Weaver swore J.D. Taylor in for a council position to fill the vacancy of Richard Nigh.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Motion was made by Councilman J.D. Taylor, seconded by Councilman John Phillips, III to approve the minutes. Unanimously approved.

Curb Cut Request – George Glenn Fuscsick

Mr. Fuscsick purchased and is remodeling the property located at 35 West Baltimore Street for Antietam Firearms. He is requesting a curb cut as proposed on the revised building permit.

After the Mayor and Council reviewed the drawing, motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips, II to approve the curb cut.

Mr. Fuscsick stated that he is working with Jeter Paving for flow drainage issues on Maple Street. A Storm water Management Plan is not needed because the project is less than 5,000 square feet.   The project should be completed by the end of May.

MML Dinner

A count was taken for the next MML Dinner to be hosted by the Town of Williamsport. The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m. The menu for the evening will consist of a grilled New York Steak, steamed shrimp, baked potato, salad, rolls, and desert. The cost for this meal will be $23.00.

Becky Wilson – DNR

Ms. Becky Wilson works with DNR, and a tree planting program for spring 2015 is available for tree planting.

A lengthy meeting was held regarding planting trees at the park, and different locations.

Motion was made by Councilman Rich Gaver, seconded by Councilman Luke Barnette to move forward with the tree planting project at the park on Friday, April 18th from 9:00 a.m. to 12:00 noon. Additional details will follow. Unanimously approved.

Jamie Baker – Wagon Train

Mr. Jamie Baker represents the Wagon Train. This year the schedule is for May 15-17, 2015 with a sleep over at the Funkstown Community Park on May 16th, and breakfast on the 17th, and the Wagon Train will depart to Boonsboro.

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips, III to allow the Wagon Train to use the park facilities. Unanimously approved.

Mayor Paul Crampton, Jr. read a resignation letter into the minutes from Richard (Dick) Nigh. Mr. Nigh has relinquished his position effective immediately.

A discussion was held regarding the Town Charter rules to fill a vacancy.

Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to appoint J.D. Taylor, III to fill the position of Town Council. Unanimously approved.

Tim Thompson – Military Banners

Mr. Thompson presented a Military Banner Program to the Mayor and Council. Mr. Thompson stated that the Military Banner Program was created for the City of Hagerstown to honor and recognize Military Veterans that reside in Hagerstown, MD. Banners will display the official military photo of the service member, as well as their name, rank and branch of service. Banners are placed on light poles.

Mr. Thompson stated that the program is available to all townships in Washington County.

A lengthy conversation was held regarding Funkstown participation in the program. Councilman Rich Gaver will talk to Alleghany Power since the light poles are owned by them.

Misc

Councilman John Phillips, III stated that the plans have started for the re-enactment this year. He is looking at a different band this year that is less expensive. The band would be a southern band instead of a union band.

Assistant Mayor Sharon Chirgott stated that she went to the Funkstown Fire Company’s banquet, and it was well attended.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to pay the bills. Unanimously approved.

MINUTES

JANUARY 12, 2015

The regular meeting of the Funkstown Mayor and Council was held on Monday, January 12, 2015 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., and Rich Gaver.

Also in attendance were Kay Bosgroof, Richard Grassby, Barry Warrenfeltz, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Councilman Rich Gaver, seconded by Councilman Luke Barnette to approve the minutes with the following correction: remove Assistant Mayor Sharon Chirgott from the attendance list. Unanimously approved.

Misc

The County Commissioners will meet in Funkstown on February 10, 2015 at 7:00 p.m. at Town Hall.

Ms. Kay Bosgroof lives at 29 West Baltimore Street. She is very concerned that a gun shop will be opening a business next door to her residence.

The Mayor and Council explained that a gun shop is a permitted use in Town Center district. The business will have to get the proper permits and meet parking requirements.

Mr. Barry Warrenfeltz thanked the Mayor and Council for cleaning up the property on High Street.

Councilman Rich Gaver provided the Mayor and Council an end of the year report for Troop 23.
