MINUTES

DECEMBER 12, 2022

The regular meeting of the Funkstown Mayor and Council was held on Monday, December 12, 2022 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Terry Feiser, Gary Middlekauff, John Phillips, III, Barry Warrenfeltz, and Rich Gaver.

Also in attendance were Kery Swope, Albright, Crumbacker and Moul & Itell; Kelli Roser, Town Secretary; and Brenda Haynes, Town Manager.

The meeting of the Mayor and Council, in compliance with the Maryland Open Meetings Law and the Emergency Ordinance of the Town regarding Open Meeting Compliance, will be audio streamed via the Town’s Facebook page.  In person attendance is now permitted at the meetings with social distancing and masks are optional.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Motion was made by Councilman Rich Gaver, seconded by Councilman Terry Feiser to approve the minutes.  Unanimously approved.

Audit Report – Albright Crumbacker Moul & Itell

Mr. Kery Swope, Manager with Albright Crumbacker and Moul & Itell, LLC, presented the annual audit report.  The Town has a “clean, unqualified opinion.”

Email from Transportation Engineer, Washington County – Stouffer Avenue

Ms. Tamara Pitts is a Transportation Engineer for Washington County.  Residents have expressed concern in regards to the traffic using it as a cut through street, and also the vehicles speeding.  Traffic data is being evaluated, and surveys will be mailed to the residents on Stouffer Avenue about possibly making the street one-way.

Misc

Councilman Rich Gaver stated that the Olde Tyme Christmas celebration was a success.  The wagons were full all evening, the pony rides had a good turnout, and there were over 500 meals served at the fire company.

This will be Councilman Rich Gaver’s last year serving as the Chairman.  He has enjoyed chairing the event for over 25 years, and will be glad to help out, but it is time to find a replacement.

Mayor Paul Crampton, Jr. thanked Councilman Rich Gaver for all his help over the years with the event.

Councilman Barry Warrenfeltz thanked Councilman Rich Gaver for all his help with the event.

Councilman John Phillips, III thanked the Mayor and Council for the flowers in the passing of his father.

Councilman John Phillips, III stated that the Funkstown Fire Company had Santa on the fire truck coming through the Town for the kids to see.

Councilman Gary Middlekauff thanked the Mayor and Council for the flowers in the passing of Mr. Nigh, a long time Councilman for the Town.

Councilman Gary Middlekauff stated that his car got hit the other evening while it was parked on Poplar Street.

Councilman Terry Feiser thanked Councilman Rich Gaver and his wife for all their hard work over the years on the Olde Tyme Christmas event.

Assistant Mayor Sharon Chirgott thanked Councilman Rich Gaver for his work on the Olde Tyme Christmas event, and stated that he has set the bar high for the next Chair Person.

Assistant Mayor Sharon Chirgott stated that at the last MML Dinner speaker Larry Boldon, from LGIT gave a presentation regarding 1st Amendment Auditors.  It is basically where citizens come in to the office and video you discussing and answering questions about Town operation. 

LGIT offers Risk Management Training through MML for office staff.

NOVEMBER 14, 2022

The regular meeting of the Funkstown Mayor and Council was held on Monday, November 14, 2022 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Barry Warrenfeltz, Terry Feiser, and Gary Middlekauff.

Also in attendance were Charlie Evans, Deena Royce, Marie Royce, George Glenn Fuscsick, Patrick Hoffmaster, Sherri Duvall, and Brenda Haynes, Town Manager.

Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to approve the minutes.  Unanimously approved.

Funkstown Fire Company – Glenn Fuscsick

Mr. Glenn Fuscsick is representing the Funkstown Fire Company, and is on their Building Committee.    They need a larger bay area to house the hazmat units for the Washington County hazmat apparatus.  The only way to expand is to go to the left of the building, and there is a sewer line in that immediate area.  The question came up whether the Mayor and Council would allow the fire company to build over the sewer line, or the potential of moving the sewer line, which would be very costly.  Mr. Fuscsick met with Huntzberry Brothers to get a cost of relocating the sewer line.  A discussion was held concerning the sewer line and the new addition.  The consensus with the Mayor and Council would be to allow the fire company to replace the current sewer line if it could be engineered properly.  The fire company will further investigate options, and get back with the Mayor and Council.

Misc

Councilman Rich Gaver stated that this will be the last year of chairing the Olde Tyme Christmas event.  He has been in charge of the event for 22 years, and he feels it is time for someone else to take over the event.

Councilman Barry Warrenfeltz stated that the construction for the warehouse project on Edgewood Drive is starting to get annoying. 

Mayor Paul Crampton, Jr. stated that Connor Shank did an excellent job with the Halloween Parade this year. 

MML Dinner

A count was taken for the next MML Dinner to be hosted by the Town of Clear Spring.  The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of Chicken Bruschetta, Smoked Beef Brisket, Potatoes Au Gratin, Roasted Vegetable Medley, and Dinner Roll.  The cost for this meal will be $30.00.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to pay the bills.  Unanimously approved.

Connor Shank – Halloween Parade, October 27, 2022

Mr. Connor Shank will be heading up the Halloween Parade this year.  Participants to date that will be in the parade are Western Heights Band, Northern Middle Band, South High Band, E Russell Hicks Band, Boy Scouts, Antique Car Club, Animal Health Clinic of Funkstown, and the Funkstown Fire Company Trucks.  The Washington County Sheriff’s Dept will lead the parade.

Digital Sign

A lengthy discussion was held regarding placement of the digital sign at the monument.  Councilman Rich Gaver stated that a large amount of people are in opposition of the monument placement.  The sample sign has been moved to the opposite corner beside the old Valley Supply Building.  Public input at the meeting is mostly in favor of the new location.

Design/Build Upgrades for Five (5) Wastewater Pumping Stations

There were six companies that attended the mandatory Pre Bid Meeting. Only one bid was submitted.  No decision will be made until the I&I project is put out to bid, and a price is confirmed.

Misc

Councilman Gary Middlekauff stated that he passed around a petition on Poplar Street for speed bumps or speed humps on Poplar and Chestnut Streets.  The majority wants speed humps.  Councilman Middlekauff presented a proposal from RFP, Inc. for installation of speed calming devices.  The cost for four complete calming devices would be $18,800, and the cost for seven complete calming devices would be $30,000.00.

Councilman Rich Gaver stated that New Market has speed cameras and there are no schools in the Town.   Further research will be done to verify the legality of speed cameras.

A lengthy discussion was held on Town residents who were in favor and opposition.

Town residents are very concerned about the daily blasting that is occurring due to the construction of the warehouses on Edgewood Drive.  Mayor Paul Crampton, Jr. stated that all blasting is controlled by the State Fire Marshal.

Connor Shank – 2022 Funkstown Food Truck Festival

Mr. Connor Shank stated that the event was a huge success.  There were 62 runners and 54 finished the race.  There were five Food Trucks.  Overall comments from the food truck owners is that for a first time event, they did not expect the turn out to be that large.

Halloween Parade – October 27, 2022 & Trick or Treat – October 28, 2022

Mr. Connor Shank will be heading up the Halloween Parade this year.  The town manager will still get the State Highway Approval Permit.  The parade will be held on Thursday, October 27th at 6:00 p.m.

Trick or Treat will be held on Friday, October 28th from 6:00 to 8:00 p.m. 

MML Dinner

The next MML Dinner will be held on Monday, September 26th and will be hosted by the Town of Keedysville.  The meeting will be held at the McClellan Gun Club.  The social hour will begin at 6:00 p.m.  The menu for the evening will consist of grilled steak, baked potato, vegetable, and dessert.

Misc

Mr. Dave Williams stated to the Mayor and Council that he is a candidate running for County Commissioner.  Mr. Williams is a retired Washington County Public School Library Media Specialist who served Clear Spring Middle, South High, Williamsport High, and North High over his 40 year career.  Mr. Williams lives in Smithsburg with his wife, Melissa.

A discussion was held regarding placement of the digital sign at the monument.  Mayor Paul Crampton, Jr. stated to place a dummy sign to get public input from the residents.  State Highway approved the sign to be placed at the monument.

Connor Shank – Funkstown Food Truck/5K Run

Mr. Connor Shank gave an update on the event scheduled for Saturday, September 3rd from 5:00 p.m. to Dark.  Currently there are five food trucks and the 5K run will start at 6:00 p.m.  There are 65 runners to date, and packets will be distributed at pavilion one starting at 4:30 p.m.  The Vantastics will be playing from 5:00 to 8:00 p.m., and fireworks will start at dark.

Misc

Mr. Dave Harman stated that the Funkstown Fire Company will be having the Duck Race in conjunction with the chicken barbecue on Saturday, August 27th.

Mr. Dave Harman discussed with the Mayor and Council the Town’s website.  He stated that the Town should have a .gov website.  A discussion was held regarding the website, and outsourcing to create a better site that is user friendly.

Councilman Rich Gaver discussed purchasing a message board with Hotel/Motel funding.  A 16 millimeter would cost $16,386, and a 10 millimeter would cost $18,532.  Options for placement would be in front of Town

Hall, or at the Monument.  Councilman Terry Feiser will contact State Highway Administration for approval and/or restrictions.   

Councilman John Phillips, III stated that the Re-enactment was a huge success.  The street battle and forging was great.  Stonebridge had specials and discounts if people were dressed in re-enactment outfits.  Next year will be 160th Anniversary.

Councilman Terry Feiser thanked Councilman John Phillips, III for a wonderful job with the Re-enactment.

Assistant Mayor Sharon Chirgott thanked Councilman John Phillips, III for an outstanding job with the Re-enactment.

Public Hearing

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments to consider whether or not to revise the garbage rates as they now exist.

There were no public comments at the hearing.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to close the public hearing.  Unanimously approved.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the minutes for June 20, 2022.  Unanimously approved.

Garbage Rate Increase

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to increase the garbage rates from $41.00 per quarter per household to $42.00 per quarter per household.  The increase will be $1.00 per quarter per household.  Unanimously approved.

Luke Demers – Boy Scout Troop 23 Eagle Project

Mr. Luke Demers would like to construct a fire pit at the Funkstown Community Park for his Eagle Project.  He proposes that the fire pit will be a 15×15 area with the pit in the middle.  A tree by the tennis courts would be removed, and decorative stones would be placed around the fire pit area.

Motion was made by Councilman John Phillips, III, seconded by Councilman Gary Middlekauff to allow Luke Demers to construct a 15×15 fire pit at the Funkstown Community Park for his Eagle Project.  Unanimously approved.  Councilman Rich Gaver abstained from voting.

Dixon Troxell Post 211 Baseball Field Agreement

Mr. Matt Smith attended the Mayor and Council meeting representing the Funkstown American Legion Baseball Team.  A lengthy discussion was held regarding the expired Agreement between the Town and the American Legion for use of the baseball field and concession stand.  The Agreement was last signed April 1, 2004, and was for ten (10) years expiring March 31, 2015.  Pavilion number three is being used by the baseball teams, and the office is experiencing difficulty reserving that pavilion.  Further discussion will be held at another meeting.

Re-enactment Update

Councilman John Phillips, III stated that registrations are coming in very good.  To date there are 140 to 150 confederates, and 70 to 80 union soldiers.  A discussion was held to finalize details for the re-enactment.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, July 25, 2022 hosted by the Town of Williamsport.  The meeting will be held at the Springfield Farm barn.  The social hour will begin at 6:00 p.m., followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of crabs, fried chicken, corn on the cob, macaroni salad, vegetable tray, cheese tray, beverages, and adult beverages.  The cost for this meal will be $50.00.

Misc

Councilman Barry Warrenfeltz stated that the traffic light on Baltimore Street and Edgewood Drive is not cycling correctly.  The town manager will contact State Highway.

Councilman Gary Middlekauff stated that the storm drain on Poplar Street needs repaired.

Councilman Terry Feiser stated that he emailed Mr. Lyles to have the street and stop signs installed at Gaver Meadows.

JUNE 20, 2022

A special meeting of the Funkstown Mayor and Council was held on Monday, June 20, 2022 at 6:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Barry Warrenfeltz, Rich Gaver, John Phillips, III and Gary Middlekauff.  In attendance by phone conference was Terry Feiser.

Also in attendance was Brenda Haynes, Town Manager.

This meeting of the Mayor and Council, in compliance with the Maryland Open Meetings Law and the Emergency Ordinance of the Town regarding Open Meeting Compliance, will be audio streamed via the Town’s Facebook page.  In person attendance is now permitted at the meetings with social distancing and masks are optional.

Public Hearing

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a proposed water rate increase and adoption of the General Fund and Enterprise Fund Budgets.

The public hearing is scheduled pursuant to the provisions of the Annotated Code of Maryland and the Charter of the Town of Funkstown, to consider whether or not to revise the water rates, and adoption of the budgets.

There were no public comments at the hearing.

Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to close the public hearing.  Unanimously approved.

Constant Yield Tax Rate

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to keep the Constant Yield Tax Rate at .37 per hundred dollars.  Unanimously approved.

Water Rates

The City of Hagerstown will have a three percent water rate increase effective July 1, 2022.

Motion was made by Councilman John Phillips, III, seconded by Councilman Barry Warrenfeltz to increase the in town and out of town rates by three percent.  Unanimously approved.

Budget

Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to adopt the General Fund and Enterprise Fund Budgets for Fiscal Year July 1, 2022 to June 30, 2023, and the Budget Ordinance.  Unanimously approved.

Waste Collection Bids

Waste Collection Bids were accepted for Fiscal Year July 1, 2022 to June 30, 2023.  Apple Valley Waste bid was $139,529, and Collectors Trash and Lawn Service, LLC was $72,180.

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips, III to accept Collectors Trash and Lawn Service, LLC waste collection bid.  Unanimously approved.

WWTP Operator Agreement

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to accept the new Wastewater Treatment Plant Operator, Patrick Hoffmaster.  His fee for Fiscal Year July 1, 2022 to June 30, 2023 will be $72,000.  Unanimously approved.

Park Name

A lengthy discussion was held, and input has been received by the Mayor and Council for the new park located on Poplar Street.

Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to name the park land on Poplar Street “Jerusalem Park”.  Unanimously approved.

A count was taken for the next MML Dinner to be held on Monday, May 23, 2022 and will be hosted by the Board of County Commissioners.  The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of Top Round of Beef with Au Jus and Horseradish or Garlic & Herb Chicken Breast with creamy lemon garlic sauce, tossed garden salad, oven browned red bliss potatoes, green beans, dinner rolls, chocolate cake with peanut butter icing or yellow cake with white icing.  The cost for this meal will be $30.00.

Misc

Ms. Bette Shifler lives at 20017 Beaver Creek Road.  She started a petition opposing  a zoning reclassification for 19817 Beaver Creek LLC located on the west side of Dual Highway and 19817 Beaver Creek Road.  The present zoning is RM-Residential Mulit-family and the proposed zoning is HI-Highway Interchange.  The property is 131.28 acres.

Mr. Seth Wilson introduced himself to the Mayor and Council.  He is a candidate for Delegate District 2A.  His platform is accountability, security, and integrity.

Councilman Rich Gaver stated that he has received a lot of suggested names for the new park.  The Mayor and Council will discuss the names further at the June 8th Workshop meeting.

Connor Shank –Funkstown Food Truck 5K Trail Run/Walk

Mr. Connor Shank discussed the Funkstown Food Truck 5K Trail Run/Walk to be held on Saturday, September 3rd.  The race will start at 6:00 p.m. and should finish by 7:15 p.m.  A lengthy discussion was held regarding activities for the entire day.  A complete agenda for the day will be forthcoming. 

Terry Feiser – Funkstown Zoning Ordinance Change

Councilman Terry Feiser discussed with the Mayor and Council that he met with the Town Attorney regarding zoning issues in the Town.  Several changes need to be made to the Funkstown Zoning Ordinance for the Town Center (TC) district.  The Mayor and Council has the authority to make the necessary changes.  The time line for reviewing, meetings, and holding a public hearing for adoption would be approximately four to six months.

Town Bulk Clean Up – Saturday, May 28, 2022

Town Clean Up is scheduled for Saturday, May 28th at the Funkstown Community Park from 8:00 a.m. to 1:00 p.m.

Connor Shank –Funkstown 5K Run

Mr. Connor Shank would like to have the Funkstown 5K Run on the same weekend as the Re-enactment.  Councilman John Phillips, III stated that he is anticipating a larger group of re-enactors this year, and would like to expand the battle to the Artz Farm.  A lengthy discussion was held regarding whether both events could take place on the Artz Farm and not be a conflict.  The Mayor and Council would like Councilman John Phillips, III to find out how many re-enactors will be attending, and a decision will be made before the meeting next month.

Chad Walker – National Pike Festival

The National Pike Festival will be held on May 20-22, 2022.  They will arrive at the Funkstown Community Park on Saturday, May 21st for the Wagon Train overnight encampment at 5:30 p.m.  A breakfast will be served on Sunday morning, and the Wagon Train departs at 10:00 a.m.

Motion was made by Councilman Rich Gaver, seconded by Councilman Terry Feiser to allow the National Pike Wagon Train to stay overnight at the Funkstown Community Park, and give a donation of $500.00 from the Hotel Motel funding.  Unanimously approved.

Memorandum of Agreement – Maryland State Low Income Household Water Assistance Program (LIHWAP)

The LIHWAP is part of a federally-funded American Rescue Plan program that provides assistance to help households pay water and wastewater bills.  Depending on your income and specific needs, you may qualify for the assistance.  The LIHWAP is available statewide and provides Maryland households with financial relief toward water and/or wastewater bills.  Eligible households may receive up to $2,000.  LIHWAP funding is limited and applications will be accepted on a first come, first served basis.  This program will assist eligible low income households with past due water and/or wastewater bills.

Motion was made by Councilman Rich Gaver, seconded by Councilman Terry Feiser to approve the Memorandum of Agreement for Funkstown to participate in the Maryland State Low Income Household Water Assistance Program (LIHWAP).  Unanimously approved.

MML Dinner

A count was taken for the next scheduled MML Dinner will be held on Monday, March 28, 2022 and will be hosted by the Town of Boonsboro.  The meeting will be held at the Clopper-Michael American Legion Post #10 located at 710 North Main Street, Boonsboro.  The social hour will begin at 6:00 p.m., followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of baked ham, baked stuffed chicken breast, mashed potatoes, green beans, coleslaw, tolls, vegetable tray with dips, pie, coffee and iced tea.  The cost for this meal will be $25.00.

Public Hearing – Charter Amendment

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a Charter Amendment that Section 36A be added to of the Town of Funkstown, Maryland, charter, as adopted and subsequently amended to read as follows:

§36A Run-off Elections

     Should any election conducted pursuant to this Charter result in two or more candidates for an elective office receiving an equal number of votes, such that the outcome of the elections may not be determined, the Board of Supervisors of Elections shall call for a special election at the earliest possible date, but not later than fourteen days after the date of the election in which the tie vote occurred.  Notice of the election shall be given in accordance with Section 29 of the Charter.  Registration shall remain open prior to the run-off election in the manner provided by the Charter.  The conduct of the election shall be in accordance with Section 34 of this Charter.  The ballots or voting machines shall set forth the name of each candidate who shall have received an equal number of votes, in alphabetical order, with no party designation of any kind.  The ballot or voting machine shall not provide for write-in candidates.  The procedure following the election shall be in accordance with this Charter as to any elective office in which the provisions of this section are applicable, the results of the election, even if previously certified to the Clerk of the Town, shall not result in a declaration of election with respect to the office or offices in which the election provided for in this Section is conducted, but the incumbent official or officials shall remain in office until the new official or officials for such position or positions have been elected.  In the event two or more candidates in a run-off election receive an equal number of votes, such that the election is not decided, the Council shall, by a majority vote, excluding candidates who appeared on the ballot or voting machine in a run-off election, select and declare one of the candidates in the run-off election.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve Resolution 2022-1 – Resolution of the Mayor and Council of the Town of Funkstown, Maryland, to add to the corporate Charter §36A Run-Off Elections.  Unanimously approved.

     Notice is further given that the Amendment proposed by the Legislative Body of the Town of Funkstown, Maryland, to the Town of Funkstown, Maryland, Charter shall become and be considered a part of the Municipal Charter, according to the terms of this Amendment, in all respects  be effective and observed as such, upon the 50th day after passage, as set, unless on or before the 40th day after passage there shall be presented to the Mayor and Council (Legislative Body) or mailed to it by registered mail, a Petition for Referendum in accordance with the applicable provisions of the Local Government Article of the Annotated Code of the Public General Laws of the State of Maryland.

Connor Shank

Mr. Connor Shank would like to have the 2nd Annual Funkstown 5K Run on Saturday, July 16, 2022 at 8:00 a.m.   The Racine MultiSports, LLC contract is the same as last year, but with an increase of $100, bringing the total contract price to $1,300.    A lengthy discussion was held regarding having the 5K run on the same weekend as the Re-enactment.  Councilman John Phillips, III indicated that the Re-enactment this year will be increasing in the amount of participants and he would like to expand the battle to the Artz Farm.  Mr. Connor Shank, Councilman Rich Gaver, and Councilman John Phillips, III will work out the details to determine if both events can be held on the same weekend, and make a decision before next month’s Mayor and Council meeting.

Misc

Councilman Barry Warrenfeltz stated that St. Paul’s Lutheran Church will be hosting an Easter Egg Hunt on Saturday, April 16th from 10:00 a.m. to 12:00 noon at Pavilion 4 at the Funkstown Community Park.

Public Hearing – Annexation – Paul Crampton Contractors, Inc.

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a Petition for Annexation of +/-4.79 acres, South Edgewood Drive. This property is described as Parcel 3 Liber 6303, folio 168, together with all of the improvements, rights ways, privileges and appurtenances thereunto belonging.  

A lengthy discussion was held regarding traffic, lot size.

Mr. Kevin Spielman stated that he lived in Funkstown ten years ago, and supports the Annexation.  This will be an asset to the Town.

Mr. Ed Reagan lives on Poplar Street, and asked questions about the proposed Annexation bringing more traffic to the Town.
